General sales conditions

Article 1 - APPLICATION FIELD

The present general sales conditions apply in a exclusive way to all the sales concluded by the company SCS NUTRITION through the website www.scsnutrition.com and any other means of mail order trading.

Article 2 - PRODUCTS INFORMATIONS

In accordance with the L. 111-1 article of the French Code of Consumption, the company SCS NUTRITION presents on its site the products to be sold with their essential characteristics by technical index cards. The choice and the purchase of a product are placed under the only responsibility of the buyer.

Article 3 - RESPONSIBILITY

The company SCS NUTRITION decline any responsibility if the delivered article does not respect the legislation of the delivery country (it falls to the purchaser to make sure that the order contains only products which the legislation of its country authorizes).

Article 4 - ORDERS

Once accepted by the company SCS NUTRITION, the ordering of the customer could be cancelled only with our assent and in conditions which we will compensate for any damage that this cancellation could involve and this, even in the event of delay of delivery. The buyer will receive from the company SCS nutrition a confirmation E-mail of his order after validation of this one.

Article 5 - PRICE

The prices indicated in euros are all inclusive of tax (5,5% French VAT included) and are modifiable at any time without advance notice within the bounds of regulations in force, knowing that articles will be charged on the basis in force at the recording of the order. When the purchaser validates the order by selecting a mean of payment, the sale is reputed concluded (agreement on the goods and the price). If the prices drop after the order (the prices are reactualized in real time), the company SCS NUTRITION will not be able in no case, to compensate you for the difference. If the prices increase, SCS NUTRITION is committed delivering the customer to the price fixed at the moment of the order. In these two cases,the prices entered on the order are firm and definitive. All the orders are charged in euros and payable in euros. For any delivery being done on the outside of the European Union, the customer will be exonerated from VAT, the total of the order will be thus indicated net of tax, in the same way the invoice will be established excluding French VAT. The possible customs duty or the local taxes stay chargeable to the addressee.

Article 6 - DESPATCH AND DELIVERY TIME

All the banking transactions are carried out via Caisse d'Epargne online secured payment (SP PLUS): the purchaser will never communicate to the company SCS NUTRITION its banking co-ordinates, those will be crypted via SSL (Secure Socket Layer) protocol and will never forward in plain on the network. The purchaser can pay either by Bank card, or by Cheque. In addition to this secured service, the purchaser has the possibility of paying directly the company SCS NUTRITION by credit transfer.

Article 8 - RETRACTION

In accordance with the L. 121-16 article of the French Code of Consumption, for all the operations of sale at distance, the purchaser of a product has a seven clear days deadline as from the delivery of his order to make return of this product to the salesman for exchange or refunding, without penalties except for return shipping charges. If this period expires normally a saturday, a sunday or a public holiday or day off, it is extended until the next first workday. Any return of goods must be in its state and original packing, sealed and not begun with the original invoice and is is carried out with the expenses, risks and dangers of the buyer.

Article 9 - PROPERTY RESERVE

The delivered goods remain the property of the company SCS NUTRITION until the integral payment of their price. The transfer of property of products for the benefit of the buyer, will be carried out only after complete payment of the price by this last one, and this whatever is the delivery date of the aforementioned products. From the delivery, products are placed under the responsibility of the customer who then supports all the risks, losses or insurance damages. It falls to the customer, except contrary stipulation, to ensure the expenses and the risks of the transport of the sold products. In the event of damage or of lack, the customer must do any necessary contesting on the delivery order in the two days by letter registered with acknowledgement of delivery to the conveyor and company. No complaint will be accepted in case of disregard of these formalities.

Article 10 - ABSENCE OF RESPONSIBILITY FOR CONSEQUENTIAL DAMAGES

In all the measurement permitted by the applicable laws, the company SCS NUTRITION will not be able to in no case to be held responsible for any damage, whatever nature it is (in particular and in a nonrestrictive way of any loss of benefit, interruption of activity, loss of commercial information or any other loss of pecuniary nature), resulting from the use or impossibility of using a product, even if the company SCS NUTRITION was warned of the eventuality of such damages.

Article 11 - ATTRIBUTION OF JURISDICTION

The Commercial court of Strasbourg will be only competent in case of dispute of all kinds or of contesting relative to the forming or to the execution of the order.

Article 12 - ACCEPTANCE OF THE BUYER

The present general sales conditions as well as the rates are expressly approved and accepted by the buyer, who declares and recognizes to have a perfect knowledge of it, and give up, therefore, so to prevail himself of any contradictory document and, notably, its own general purchase conditions, the act of purchase involving acceptance of these general sales conditions.

The present conditions are modifiable at any time and without advance notice by the company SCS NUTRITION, the modifications being then applicable to all posterior orders.
